Box 1000 Duluth, Minnesota 55814 Dear Mr. Anderson: We refer to your request that we review 37 paid travel vouchers that your employing agency, the United States Army Tank-Automotive Command, Warren, Michigan, found to be fraudulent. You were found guilty on 37 counts of filing false travel claims in the United States District Court, Eastern District of Michigan, Southern Division, United States of America v. Roy Anderson, Criminal No. 87-80316, and you are currently appealing your conviction to the United States Court of Appeals, Sixth Circuit. Your claim was first received in this Office on November 24, 1987; therefore, we are precluded from considering any claims that arose prior to 6 years from that date. 31 U.S.C. § 3702(b)(1) (1982). However, more importantly, this Office has a longstanding policy not to rule on any matter that is currently before a court of competent jurisdiction since such matters are best left to the courts to decide. William C. Ragland, 62 Comp. Gen. 399 (1984). Since the claims you have filed are currently the subject matter of your appeal, we will not take any further action on your claim at this time.
