Dear Senator Talmadge:


        This is in response to your letter to the Director of our Office of
   Congressional Relations concerning correspondence from the Reverend
           of Martinez, Georgia, about which you request our report. Reverend
   I       requests assistance in recovering compensation which he believes
   is due him for emotional and financial hardship which he says resulted when
   the General Accounting Office (GAO) attempted to collect a debt from him
   which he did not in fact owe. He claims that the GAO wrongfully collected
   from him about $2,000 before finally acknowledging that the debt was not
   his. He further protests a ruling against him by Judge Anthony Alaimo of
   the United States District Court for the Southern District of Georgia,
   Augusta Division. Reverend          alleges that although he had suffered
   hardship, he has not received any compensation, that he has not seen a
   copy of the Judge's written opinion against him, and that he has been
   denied his right to a trial by jury.

        Under the provisions of 31 U.S.C. § 71 (1976) and the Federal Claims
   Collection Act of 1966, 31 U.S.C. §§ 951-953 (1976), debts of Government
   agencies which they are unable to collect, may be referred to the GAO
   for collection action. 'On March 4, 1971, the Marine Corps referred for
   collection by GAO its claim against one                    (not Reverend
           but another veteran, apparently with the same name), representing
   allotment overpayments in the amount of $731.69. After failing in attempts
   to locate this debtor, the GAO Claims Division closed its file on this
   debt in November 1972. A year later, November 1973, the Veterans
   Administration (VA) referred to GAO a claim it had against the same
           for default on a VA-guaranteed housing loan in the amount of
    $1,112.38. On the referral form, VA mistakenly showed the address of
    the Reverend        as the address of its debtor, and not the address
    of the                  who had in fact defaulted on the loan.
