          Dear Mr. Chairman:

          This is in response to your letter dated May 22, 1987,
          requesting the views of this Office on the applicability of
          certain House and Senate expedited procedures set forth in
          the International Security and Development Cooperation Act
          of 1985, (ISDCA), Pub. L. No. 99-83, S 722, 99 Stat. 190)_-
          258 (1985), to the Administration's recent budget request
          for $105,000,000 in assistance to the Nicaraguan Democratic
          Resistance.

          As set forth below, the expedited procedures set forth in
          ISDCA appear to be available in the Senate for the con-
          sideration of the President's fiscal year 1988 budget
          request for assistance to the Nicaraguan Democratic Resis-
          tance. Further, the applicability of the Senate expedited
          procedures to the President's request does not appear to be
          dependent on the extension of the provisions of section 722
          of ISDCA by section 215 of Title II of the Military Con-
          struction Appropriations Act, 1987. Because of the
          necessarily short period of time available to prepare this
          letter, our conclusions represent only the tentative opinion
          of this Office. Further, these provisions deal with the
          rules of the Senate and, accordingly, the final authority to
          interpret these provisions rests with the Senate itself.


          BACKGROUND

          Subsection 722(p) of the International Security and Develop-
          ment Cooperation Act of 1985, Pub. L. No. 99-83, 99 Stat.
          190, 25;V1985) (ISDCA), provides for submission by the
          President of requests for budget and other authority to
          provide additional assistance for the Nicaraguan democratic
          resistance.
