      Dear Mr. Chairman:

           This responds to your January 19, 1978, reauest for the
      General Accounting Office's view on S. 1641, 95th Congress,
      a bill to provide that certain matters not be considered
      as letters for purposes of the Private Exoress Statutes.

           The Private Express Statutes include 39 U.S.C. 601-06
4,    -and 18 U.S.C. 1693-99 and 1724 (1970). These provisions
      basically reserve for the Postal Service the revenue
      obtainable in the carriaqe of letters for compensation.
      Private carriage generally is permitted only if postage
      is paid. 39 U.S.C. 601(a)(2) (1970).   The Private Express
      Statutes protect postal revenues so that the Postal Service
      can meet its legal obligations to provide mail service
      throughout the Nation. If mail volumes were to decline
      significantly due to weakening of the statutes, a dis-
      proportionate part of postal costs would remain to be
      apportioned over fewer pieces of mail, resulting in higher
      postal rates.

           Although the stated objective of S. 1641 is to orovide
 that certain matters not be considered as letters for purposes
      of the Private Express Statutes, the bill does not provide
      a statutory definition of a letter, nor does it include
      any of the items that constitute letters. The central term
      letter is not defined in the current statutes either.
      To administer the statutes the Postal Service has oublished,
      after a lengthy notice-and-comment rulemaking proceedinq,
      detailed regulations that include a definition of letter.
