           To the President of the Senate and the
           Speaker of the House of Representatives

           This letter reports on the status of budget authority that was
           proposed for rescission by the President in his seventh
           special impoundment message for fiscal year 1990, dated
           June 28, 1990, but for which the Congress has not passed a
           rescission bill as defined in section 1011(3) of the
           Impoundment Control Act (the Act). All the budget authority
           withheld pursuant to the rescission proposals submitted in the
           seventh special message has been released by the Office of
           Management and Budget (OMB) for obligation. The rescission
           proposals for which funds were withheld are set forth in the
           enclosed listing submitted by the President with his seventh
           special message.

           Section 1012(b) of the Act requires that funds proposed for
           rescission be made available for obligation unless the
           Congress completes action on rescission bills within the 45
           day period of continuous congressional session following the
           day such proposal is received by the Congress. For the
           rescission proposals submitted in the seventh special message,
           the 45 day period ended on September 24, 1990, without the
           Congress having passed such a bill.

           We have confirmed that on September 25, 1990, all funds
           proposed for rescission were made available by OMB for
           obligation by the Department of Defense. We note, however,
           that the bill making appropriations for military construction
           for fiscal year 1991, H.R. 5313, now making its way through
           Congress, contains approvals of all the proposed rescissions
