In the President's third special message for fiscal year 1983, dated December 16, 1982, the President proposed rescis- sion of $2 million in budget authority that had been made available to the Department of Commerce, National Oceanic and Atmospheric Administration, for construction (R83-1). Sec- tion 1012(b) of the Impoundment Control Act requires that funds proposed for rescission be made available for obliga- tion unless Congress completes action on a rescission bill within the 45-day period of continuous congressional session following the day such proposal is received by Congress. For rescission proposal R83-1, the 45-day period ended on March 24, 1983, without Congress having passed such a bill. We have confirmed that on March 25, 1983, the office of Management and Budget apportioned the subject budget author- ity to the Department of Commerce, National Oceanic and Atmospheric Administration, for construction.
