          Subject: Environmental Protection Agency: Revisions to the Water Quality Planning
                  and Management Regulation and Revisions to the Natio nal Pollutant
                  Discharge Elimination System Pro gram in Support of Revisions to the Water
                  Quality Planning and Management Regulation

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Environmental Protection Agency (EPA), entitled
          Revisions to the Water Quality Planning and Management Regulation and Revisions
          to the National Pollutant Discharge Elimination System Program in Support of
          Revisions to the Water Quality Planning and Management Regulation (FRL-6733-2).
          We received the rule on July 11, 2000. It was published in the Federal Register as a
          final rule on July 13, 2000. 65 Fed. Reg. 43586.

          The final rule revises and clarifies EPA's current regulatory requirements for
          establishing Total Maximum Daily Loads (TMDLs) and the National Pollutant
          Discharge Elimination System under the Clean Water Act.

          Enclosed is our assessment of the EPA's compliance with the procedural steps
          required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
          Our review indicates that, with the exception of the determination regarding the
          Unfunded Mandates Reform Act of 1995 as discussed in the report cited below, the
          EPA complied with the applicable requirements.
