         Subject: Department of Energy, Federal Energy Regulatory Commission: Regional
                 Transmission Organizations

         Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
         major rule promulgated by the Department of Energy, Federal Energy Regulatory
         Commission (Commission), entitled Regional Transmission Organizations (Docket
         No. RM99-2-000). We received the rule on January 7, 2000. It was published in the
         Federal Register as a final rule on January 6, 2000. 65 Fed. Reg. 810.

         The final rule amends the Commission's regulations under the Federal Power Act to
         advance the formation of Regional Transmission Organizations (RTOs). The rule
         requires that each public utility that owns, operates, or controls facilities for the
         transmission of electric energy in interstate commerce make certain filings with
         respect to forming and participating in an RTO.

         Enclosed is our assessment of the Commission's compliance with the procedural
         steps required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the
         rule. Our review indicates that the Commission complied with the applicable
         requirements.
