Dingell Ranking Minority Member Committee on Commerce House of Representatives Subject: Federal Communications Commission: Direct Broadcast Satellite Public Interest Obligations Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major rule promulgated by the Federal Communications Commission (FCC), entitled Direct Broadcast Satellite Public Interest Obligations (MM Docket 93-25; FCC 98-307). We received the rule on December 29, 1998. It was published in the Federal Register as a final rule on February 8, 1999. 64 Fed. Reg. 5951. The final rule imposes requirements on Direct Broadcast Satellite Service (DBS) providers to comply with the political broadcast rules of the Communications Act of 1934, as amended, and mandates that the DBS providers reserve between 4 percent and 7 percent of their channel capacity exclusively for noncommercial programming of an educational or informational nature. Enclosed is our assessment of the FCC's compliance with the procedural steps required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
