Dingell Ranking Minority Member Committee on Commerce House of Representatives Subject: Federal Communications Commission: Competitive Service Safeguards for Local Exchange Carrier Provision of Commercial Mobile Radio Services and Implementation of Section 601(d) of the Telecommunications Act of 1996 Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major rule promulgated by the Federal Communications Commission (FCC), entitled Competitive Service Safeguards for Local Exchange Carrier Provision of Commercial Mobile Radio Services and Implementation of Section 601(d) of the Telecommunications Act of 1996 (WT Docket No. 96-162; FCC 97-352). We received the rule on December 11, 1997. It was published in the Federal Register as a final rule on December 3, 1997. 62 Fed. Reg. 63864. In the final rule, the FCC modifies the current structural separation requirement for the provision of cellular service by the Bell Operating Companies and adopts a new requirement that all incumbent local exchange carriers provide in-region broadband commercial mobile radio service (CMRS), including cellular services, through a CMRS affiliate. Enclosed is our assessment of the FCC's compliance with the procedural steps required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule. Our review indicates that the FCC complied with the applicable requirements. GAO/OGC-98-21
