Dear Senator Riegle:

     Further reference is made to your letter dated
October 6, 1980, with enclosures, on behalf of your
constituent, Staff Sergeant Anne M. Fisher, United
States Army Reserve, 308 Van Buren, Apt. 1A, Jackson,
Michigan 49201, in which you request reconsideration
of our Claims Division's March 20, 1980 denial of
Sergeant Fisher's laim for reimbursement of t4te costs
of medical car./she obtained from civilian sources in
1978 and 1979 while she was serving on active military
duty.

     In View of the facts presented and the applicable
provisions of law and regulation, the action of our
Claims Division must be sustained. However, we also
concluded that Sergeant Fisher's case involved equit-
able circumstances of an unusual nature, and we have
therefore today reported the matter to the Congress
pursuant to the Meritorious Claims Act, 31 U.S.C.
236, with a recommendation that legislation for the
relief of Sergeant Fisher be enacted. For your further
information in that regard,. we are enclosing copies
of our report to the Congress and our transmittal
letter to the President of the Senate.

     We trust this will serve the purpose of your inquiry.
