 Gentlemen:

      This is in response to your letter of April 17, 1980,
 requesting that the G neral Accounting Office conduct an
 investigat'on f the circumstances surrounding the &wava-o
 .Zcontract*7_- he U. S. Office of Education with a view
 toward having the contract rescinded.

      Your request, as it pertains to the propriety of a
 particular contract award, would normally be treated as a
 bid protest under the procedures set forth at 4 C.F.R. Part
 20 (1980). Those procedures require protests to be filed
 within 10 working days of when grounds for protest are known
 or should be known. It is clear from your letter that you
 have not met this filing requirement.

      Our audit staff, however, is in the process of reviewing
 the Office (now Department) of Education procedures for award-
 ing grants and contracts. While the auditors do not intend
 to examine the specific award you question, they will consider
 the concerns you have expressed during that review.
