     Subject: Army claim No. JAGD-78-0-03-0220

              _Your letter of August 29, 1979

     We have rejected your offer to compromise e               claim  a-f
$-,8'17-6-against the GovernmentJbecause you have presented no legal premise
or evidence that was not considered in our decision to you of August 13,
1979, B-194208.

     In our decision we considered and rejected your contention that damage
to the mobile home resulted from the inherent vice of the unit, and con-
cluded that you had presented nothing of evidentiary value that would
justify this Office in refunding any of the monies that the Department of
the Army (Army) set off.. Although the record shows that the Army offered
to accept $445 in compromise settlement of the claim, you rejected that/'
offer. And we are not aware of the factors considered by the Army in
making the offer.

     Since you simply repeat the presentation made in your request for
review of the Army's setoff action, there is no basis for changing the
views expressed in our decision.
