Dear Mr. Chairman:

      We are responding to your questions a,bout the requirement in
Section 3 of H. R. 3943, the Experienced Pilots Act of 1979, that the
irational Institutes of health (MiH) conduct a study of theImedical justiG
fication for nandatory retirement for airline pilots At ae 0 You
asked whether IIE's enabling legislation authorizes such a Rtudy and
whether existing appropriations may be used.

      Lecause you asked for an immediate answer, we did not request
the views of the Department of -ealth, 'ducation. and  ,.elfare (Z ..
or the Federal Aviation Administration. -v e believe our position is
consistent, however, with those of the Director, 1-, and the Director,
kVational Institute on Aging, as expressed Ln letters to your Committee

      The uroposed study would appear to be authorized under the

Institute on A!cging, to carry out the general research purposes of the
Public gealth Service.:with respect to research investirations, experi- f
rients, demonstrations, and studies related to the aging process and the
diseases and other special problerns and needs of the azed * * *.  As we
, nderstand it, the wpoposed study is designed to provide information laelp-
ful to the Congress and to the secretary of T rans portation in deterrnirding
wheth'er a pilot, upon tttainin the a.ie of 60 or any other srecified afe,
uinder loes some physiologicai or ps chophysiolokieal cnan:-es so as to

of safety.  The study would also recomnt.endi tLe frequency and ty-.e of
medical exarninations Which should be qiven to nilots to assure that their
phy2ical condition is aeinz adequateiy monitored. .Ve believe this study is
cle=-ly reLhted to the ecretary's ezistInt authority to conduct research
on the aging process and is therefore authorized under present law.

      VWe also believe that there -are funds le'ally available at the present
time to be-in the study. At the moment, U2',h is operatinq under a con-
tinuing resolution which authorizes the appropriation of f[ s) uch amounts
