              This matter was the subject of decision B-191501, dated       I   1
         March 8, 1979, copy enclosed' We concLuded therein that4,    A    ll
         Hs. Pentz's civilian service 'w'as as an employee of the Inter-
         national CooperativeAdministt  oniIjcA).a__She worked on taIt :Pz- ///-
         agency's proJects and was subject to their discipline nd
         control during the period in question. There Pqas no evidence to
         show that the PIIS as an entity or. the Surgeon General as head of
         that agency had any authority over employees of the ICA, such as
         XMa, Pentz, Accordingly it washeld that none of her service
         could be con'idered as with the PUS for the purposes of
         42 U.S.C. 212,
              It is noted that Ms. Pentz staters in her letter that although
         shel had mors than the minimum years of creditable serv.ce for
         civil service retirement eligibility'puvposes while 1iorking for
         the ICA, she relinquished that right'by withdrawing her retirement
         deductions from the fund when she went on active duty Pith the PHS.
         Under the provisions of 5 U.S.C. 08334(d) and (e), if an employee
         redeposits an amount refunded, pli'- ,sinterest .Thrh the date refund
         was made to the date of redeposit, retirement credits may be
         r:estored.

              The extent to which 1s. Pentz may be eligible for recredit
         and the conditions involved should be addressed to the Office of
         Personnd 1 anagerne (formerly the Civil Service Comm~ission).
