Legislation Allows Black Lung

Benefits To Be Awarded Without

Adequate Evidence Of Disability



Social Security Administration approval of
black lung claims is based on provisions of law
which GAO believes do not adequately ensure
that benefits are provided only to thoseentitled
to them. Under the 1977 amendments to the
Federal Coal Mine Health and Safety Act such
claims were based on affidavits from spouses
and other dependent persons, inconclusive me-
dical evidence, and presumptions based on
years of coal mine employment.


GAO believes that medical evidence should
be the basis for determining disability and
death from black lung.
