Dear Mr. Burgener:

    By letters of June 27 and July 12, 1977, you reqaezted our
opinion as to whether certain parts of the regulationr issued by the
Lconomic Development Administration (ILDA) to irar  ont rou d
II of funding under the Local Public WVorks Capital DL-,,'ioprrent znd
Investmcnt Act of 176, title I of Pub. L. No. 94-3.39, 90 Stat. 99e,
as amended by the Public V orks Fniployrient At of 1977, title I
of Pub. L. No. 95-23, 91 Stat. 116, are in accordance with these
authorizing statutes and their legislative histories.

    More speciically, you expressed concern regarding the regu-
lations pertaining to school district participation because These
regulations mak rural school districts incligible to apply for any
funds under Round U unless the school distzicts serve 'thc cntir-
county'.  Since school district boundaries in the State af >t-lifornia
are not coterminous w ith county boundaries, you asscrt that 1,.8
California school districts having 203 pcndin ? applications totilling
$221, 540, 0G4 are ineli'i'le under current regulatior. , You Eag-
gest that such a reW,!t is contrary to legislative intent since Con-
gress made it quite slear that school districts wcre to participate
in the f-inding by iir.uding spccifiz l.--ag e in both the statute and
a joint exrlanatory statement of the Conferehce Committee requiring
that project applications for school districts be accorded equal pri-
ority with those of general purpose local governments under the
Act.

    For the reasons stated hereafter, we conclude that thq relevant
regulations are consistent wita the aut-orizing legislation, and we
do not believe that they proclude eligibility of rural school districts
In C--,1ifornia that do not serve th  entire county.

   A brief summary of the program mey be helpful before discussing
the pertinent regulations in order to plece-them-in perspective. The
purpose of round II funding (LPW grants) under the Local Fablic
Works Capital Development and Inve-trent Act of 197,. as amended,
as expressed by the Secretary of Commerce, in letters discussed
during the course of the Senate debate, is to target aid to econonii-
cally depressed areas of greatest need to improve the N- tion's ccute
