       Dear Mr. Chairman:

            Your letter of March 14, 1973, requested that we furnish your
       Subconmittee with information concerning theuse made of funds
     Sapproriated for fiscal year 1973 to the Federal Railroad-ld  js- 'I3
     / t rat ion fo 43 o ad =posi io.ns-i t1.i Bu.re eau of Railroad
       Saety. On Narcf 27-, 1973, we provided your office with informa-
       tion as summarized below.

  S- C'How many of the 43 additional positions funded by the Congress have
/      been filled?

            Information obtained from the Federal Railroad Administration
       indicated that none of the 43 additionn! -nrpector positions for
       which funds were appropriated for fiscal year 1973 had been or
       would be filled in fiscal year 1973. Although the fiscal year 1973
       appropriation would support a level of 336 authorized positions for
       the Bureau, the level was administratively held at the 272 positions
       authorized for fiscal year 1972. This action, in effect, prevented
       expansion of the inspector force by the additional 43 positions
       authorized by the Congress.

            The Bureau did hire eight field inspectors and engineers during
       the first 9 months of fiscal year 1973; however, the! new employees
       filled positions which were authorized, but unfilled, prior to fiscal
       year 3973.

            As of March 31, 1973, the funds authorized for the 43 addit ional
       inspector positions had not been spent or obligated, but -$5-/7000
       originally budgeted for personnel coiiipensat ion and bene]its was reprco-
       graied. lhe budget for oLher se'rvjcc was increased by .38,000, and
       the budget lor printing and reproduct ion was increased by $9 000.
