     Reference is made to your letter dated Decerber 10, 173 (fle
reference LPF-2b/A k 4265), with enclosures, requestin- a ciecision
concerninR the nronriety of usin'i a claim form as documentation for
refunds to Mlarine Corps merbers for overcharges incident to pur-
chasing uniform clothin, tarouli casA sales where the ueubers have
neither a sales receipt nor a cancelled cnaci.

     You indicate that Exc. Order :7o. 11,723, 6 C.F.1'. 612, issued
June 15, 1973, effective June 13, 1973, irmDosed a 60-day price freeze
on the sale of all corarodities offered for sale except prices cnarcd
for raw a-.ricultural proaucts.  i'rices were trozen at a Ievel not to
exceed the higheat price char!ed during the base period, June i-8.
1973. On July 1, 1973, price increases were efiective for 37 articles
of individual uniform clothing sold in M arine Corps retail clothing
outlets.

     You indicate further that farine Corps Bulletin 10120 of July 23,
1973, iripleraented the provisions of LExec. Order --o. 11,723 relative to
the retail sale of clothing to individual marines. i-ioever, during
the period from July 1, 1973, until receipt of the Marine Corps
bulletin by Marine Corps retail clothing outlets, individuals who
purchased tie articles of clothin!t whiech had a price increase may have
paid a price higher than the freeze base price. In keeping writh the
intent of the Executive order, the harine Corps has determined that
those individuals who were overchiarged are entitled to a refund.

     You say that the Marine Corps is publishinz procedures for
making refunds to individuals who were overcharged for purchases made
by mail order or for checkaee sales. However, you say that some
question exists as to the documentation requirements for proof of
purchase for cash sales in the absence of a sales receipt or a
