Gentlmen:

     We refer to your letter dated August 8, 1972, and subuaquent
correspondence, on behalf of Howell Instruments, Incorporated  0
(1lowell), protesting oiganst the Department of the Navy's use for
procurement purposes of data which you contend is proprietary to
Howell.


00-              On June 22, 1972, request for technical proposals (nIFP)
-           1100156-72-RLTP-O496 was issued by Naval Air Engineering Center,
             Phillelphio, Pennoylvania. The eolicitation called for technical
             proposez for furnishing 60 engine trim teat nets in accordance
             i4th the ';cquiremets of purchase description 35 (PD-35), dated
             June 12, 1972. These sets are used to deterraine whether an
             engine is performing efficiently and to determine what adjust-
             ments to th-3 engine are required. The requirement, included
             indicators ';o read revolutions per minute (11.1), temperature
             and preusurt, and circuitry for correcting RI and temperature
             to a atandard day condition (590Y.) and for camputing engine
             presnv.ne ratio.

                 As bachground, it is reported that the coneral requirements
            for the teat unit were not at a meeting held on Februaiy 3, 1971,
            between technical personnel from ]Howell, Navy and Pratt & Whitney
            Aircraft (r'). The record indicates that it %,us concluded at
            thin meeting that a test net wns to be furnished by Ho.elfl, under
            a subcontract with 1I, to be delivered to the Havy purcuant to
            lis prime contract (1o. 100019-70-C-0203) with the Navy for
            TF30-P-412 engines and s%pport equlpment for the F14A aircraft.
            At thie time Howefl provided the Navy witn three drawings which
            depicted the configuration of the control panel, external direna
