       j.,8o6o, and AR8,062 for add tiona. freigbt charges of $176 on
       each of three shipments of ar m tractor tanls hich were tendered
       to the rail carriers on February 9, 1967, at the Lettertenny Army
       Depot, Qulbrtson, Pennsylvania, and from there transported to
       Fort Knox, Kentucly, where they were delivered during February
       1967, The additional aounts claimed represent the differences
       between the freight charges of t352 origilly billed and paid
       during May 1967 to your company for the transportation service
       rendered on each shipment, cmputed at the balance of the through
       rate published from Patterson, New Jersey, to Fort Knox, Kentucky,
       wich applies on certain shipments accorded transit privileges at
       Culbertion, and the hiaer charges now clained based on the local
  t    rate applying fro= the transit point to destination because the
  Cr   transit privfleze did not apply via the routing designated on the
  4n'. bills of letng,
  CSince the transit basis of #charges does not apply on any o0
  cc thp three ovtlound shipment, ppayment of the additional amounts
  Sclaimd turns in the question of hether such claims were timely
       filed with the General Accounting Office. Your claims for the
J      additional charges of $176 on each of the shijeentn were first
n      received in our Office on February 9 and July 27, 1971 (tiu were
       received on the latter date).

            The eXtAm papers were returned to your company by our Trans-
       portation and tlaims Divinion with the explanation that Section 322
Lof the Transportation Act of l949+, as aended, 49 U.S.C. 66, pre-
cvented their consideration because the claims were not received
       in our Office within the 3-year period of imttions specified
       in such provision of law and thereunder are forever barred. In
       view of the action taken by our Transportation and Claims
       Division, your reclaL ' for the $176 on each of the ahiomncnto
       are being considered as requests for review of the final actions
       of the Irancortation and Claimc Division which in effect refused
       payment of such claims.
