     sion by your agency that themsalary rate at which you ware initiafly
     appointed was proper.

          In January 1970 while working as a secretary for the United States
     Attorney's Office, you rare approached by the lonorable Asa So Herzog,
     Referee in Banruptcy for the United States District Court for the
     Southern District of Now Yor)cwith an offer to join hi. staff at grade
     level JSP-8, step 9, which offer you acc'ipted, llowvner, when Referee
     Uerzog requeated your appoinrimnt by letter of January 22, 1970, to the
     Chief, Division of roronnel, Administrative Office of tho United States
     Courts, it was specifically reque.tad that your appointment be nade at
     Srado !oval JSP-, atop 7,   The pertinent part of te aforemntioned
     letter is quoted below:

          The purposo of this latter is to call to your attention that
          Ilips DeTurek, presently employed b7 tho U. S, Attorney's
          offiec in thin District, In in JSPI(10) lt a salary of
          $9,93.   I a requesting that sh! be plv2ed iu the seventh
          (th) step of Grade U at a saltry of $10,041, which ic the
          lowost step that will nots in effect, demote her so far as
          salary is concernad.

          You accepted the appointment at JSF-B, step 7, and began work on
     January 26, 1970. Approximataly 20 months later on September 13, 1971,.
     Rtoferae Hertog wrrote another letter to the CZA4 Division of Personnel,
     Adniiatrative Office of the Uited States Courts and requested a deter-
     rdnation as to whether he had bade an error in requesting appointment
     in rp 7 inatead of stop 9, as foflows:
