                 We refer to the October 1, 1973, letter from your Chief,
            Financial Systems DiVisiont reference AM 400, and to previous
            letters from your Accounting Programs Division dated May 16,
            19721 June 9, 1972, and February 7, 1973, reference AMS 430,
            regarding the claims of esars. Richard 1. Longbrake, Clyde F.
            Itecerve and Delmar M. Black for overtime compensation for time
            alleged to have been spent in a st.nudby statue at the Federal
            Aviation Administration's (FAA) Boise Cascade racility

C                By wemorandwm of this date9 ttr the reasons set forth
            below, wbo have directed our Transportation and Claims Division
            to pay the claims of those thrne individuals upon the basis of
            the accounting information provided as attnvtents to the
            letters from the Accounting Prosroms Diviioa.

                 The correspondenee ci'ted aboye indicates that thare is
            some misconception as to the legal 'bais for payment of the
            three claims proceatly'before this Office as well as the
            previously settled claims of Hr. Olin B. Cro5  and other
            employees at the FAA's Pleasants Peak fzcility.  By Settlement
            Cortificato dated November 22, 1971, 14r. Cross was paid the
            sum of $1,614.72 in satieftiction of hit claia for overtime
            cocpeusation for tine spent in a standby status nt the
            Pleanonta Peak'facility during the period from Dezember 3, 1961,
            through Harch 25, 1965s That settlement was lcgully predicated
            upon the authority of 3 U.S.C. 5542 governing cowpousation for
            overtime work inasmuch as pertinent regulations together with
            information received from the FAA substentiated the claimant's
            cont,.ntion that a minimum of two mn wmre required to remain
            a-. cite at all times.
                 Corrncpondence that wie hava received in connection with
            adjudication of the cla. rm, of Hceors. Longbrako, J1cecrve and
