          Dear Mr. Swzretaryz   -

               Reference Is made to a letter (6320 Contracting) dateM )arch 23,
          1973, from the Director of Admitn-trattra Services, rorezt Service,
          and prior correspondepce ,equestiu o r decision with respect to the
          protest filei by the 'Wayne anufactuting Co. (WayVne) against any award
          of a contract to the Edward R. Bacon CMmpmy (Baron), under invitation
          for bids (Iri) Nlo. R5-73-149, issued b:v the Forest Service, San
          Francisco, California, for furnishing uix brush chippers.

               The contracting officer propoes to uuatain the Uvits6 protest,
          reject the low bid of Bacon ($3,950 each) an uonreeponeive, aandw rrd
          the contract to Wayne ($4101 each), tho only other bidder responding
          to the IM71. For the reasons hereiuafter s att, we canclude that the
          1FP should be cwncelad and the requireamts tharounder readvertiood.
K         In reaching thin conclusion, we have considered   wonts from both
          Wayne and Bacon vhich took into account the posuible cancelatiam of
          the IFl.

               The bidding schedule of the II calied for a bruh chippor in
          accordance with an attached epecification which provided in section
          220 ans follows:

               Power tranamiemion from mgino to the c itter head ahafl be
               of a sufficiont arount of aultipla V-belt driva to insure
               adequate epod and power of cutter for Ohippini' a 6 inch
               ndinimum log. Deuign shall allow for 'o:sy adjustment and
               replacemant of the V-blts, A suitable guard shall encloe
               the drive unit. An mergancy cut-off switch oh'fl be
               included vhich shall be connected to a control located
               vithin easy reach of the operator in th :!eoding apron area
               The switch must be ebto to turn off the cutter htid neambly
