          mad prior correspondence, pr'testng avard to any other bidder
          under invitation for bids (170) MS 10-73 Issued by the tation4l
          Bureau of Stvndarda (KDS) Contracting Office, sBoulder, Colorado.

               The 1F7, issued October 4, 1972, eafled for an stinated
          7 wmonths of tiIr-haring computer servic. Six bids were opened
          on ovember 22, 1972. After evaluation of bidn, it ws dntormined
          that the Computcr Sharing Services, Inc. (CSS), total evaluated
          price of $2,319.38 was titsovest received, and the Computer Tine
          Corporation (CtC) bid evaluated at $2p600.36 vas the second lowest.
          By letter dated Decebor 4., 1972, CTC protested to ND3 on the
          basis that tho bid evaluation factor prescribed in paragraph 1.6.2
          of the specificatious was tmreasonable. ?aregraph 1.6.2 provideds

               Frogra duplicaltion and the time required to check
               out the pro -aa  after trasfor wil bo an e~ied
               expenso to the Government and the cost thereof will
               be a factor in tie avaluatcon of bids. Accordingly.
               and for evaluation purposes only. the aaount of
               $1,000.00 will be added to each bid which requires
               program duplication and check out after transfer.

          C1 cootendcd that this provlaon unduly psalized alpotential
          suppliers except CSS, the current contractor.

               By letter of Nember 22, 1972, BS denied the protest,
          stating that the evaluation factor represents an accurate depic-
          tion of the costs that the Goverammt will incur if a change In
          vendors is required. 113S also stated that the protest was
          untisaly, sinc. CIC had 49 days before bid opening to protest the
