Ccpoy against the award of contracts under invitation for bids

Supervisor of Slpbuflding, 13th nval Distaiot, San Diego#
California.

     The protest. concern thF4oeaity of the Hmae Port Folievat
applied to contracts for the repair of aval veassels. In our letter
of toda  to counsel for Harbor Boat Buldtng Ccpay, co    enclosed,
we have upheld the plcy as a legitimate requirenent of the Navy.
Noweverj we arc concerned that the atouatia application of the
polcy to al Procurements for ship overhaul , as appears to be re
quired by section 7-3.4 of the Ship Repair Contract lmnual (s'ubjt*t
to the lt 4ted exceptions specified thereiw), would place an undue
restriction on competition in those instroes where its application
wuld not further the intent of the Hcue Port Policy. Fr example,
there al or moat of the crew of a particular vessel ere tmarried
the hne port restriction voule not serve to foster the utate4
Kome Port Policy. We are not in a position to kncv whether it would
be administratively feasible for procurmrib officials to determine,
prior to the issuance of solicitations, it Ease Port Policy considera-
tions are aplicable to specific vessels. If such a determination
feasibly can be made, we bolieve the geographic restrictions of the
ome Port Policy should not be ixpoasi.
