     Reference I made to your letter of Augst lp 1973, vith enolorureu9
requesting our advance decision as to thepropriety of certifying for pay-
mentithe reclaim voucher in the amount of $325 in favor of hr. oSeymr
rtn, an employee of the Atomic Energy Co=    assion for relocation expenses
incurred by him in the purchase of a residence In Arlington Heights,
Illinois.

     The finanoial dieclmu  statement prepared unde Relation Z issued
by the Board of Governors of the Federal Reserve System shova that the
employee borrowed $40,000 for the purchase of his residence and paid a
loan service charge of 1 percent, or *40oT. e settlewit statemet and
other Jaormation provided indicate that the loan seryice charge was
Mde up of a $75 appreinsal fee and $325 in lo= charges.   ou allowed tta
$75 as boing excludable from the finance charge and disallowed 4325 on -
the ground that this oaunt was a finance charge and therefore not reis-
tu8nable under the provisions of Regulation Z.

     ubsoquently the employee obtained a statement by the Olmic
Bayings and Loan Assoclation, the lending institution in this casup
widch shows that the   25, reported as a finance chargo and an aasooia-
tion loan charges ws in fact a chage for legal fees for drawirg the
doouments of settlment and was made up of tho foflowing separate charges:
