1973, protcoting on behalf of J, S, & o., Incorporated, against
award of any contract under invitatlon for bids (IFB) No. 2320-0-4-
047-OW, issued June 14, 1973, by the JlWpartcant of General Services,
Bureau of Materiel Hanagement, overauv)nt of the District of Columbia.

     Tho subject invitation requeited btds for trash and refuse re-
moval and dioposal st-vices. Bids yere opened June 28, 1973, and
J, S, & 0, was the second low bidder. J, S & 0., the incumbent
contractor for these servichs, has had itto contract extended and is          .,
continuing to perform pending the proteut,

     The recor4 discloses that the prasident of J. 8. & 0, orally ad-
vised the contracting officer by telephone on June 27, 1973 (one day
before the bid opening), that ha ewas protesting the solicitation .pec-
ifications, and that the contracting officer replied tar. the protest
could not be considered in view of an 11.3 provieion requiring such
protests to be filed with the procurement officIn tritil\ at least
five-days before the bid opering.

     The record fuather diecloses that on June 28, 1973, iwediatoly
after the bid opening, J. So & G. filed a written protest with the
contraci;ing officer.  In filing your protest id:h titis Office, you
states

     On 28 June 1973, Protestant filed its witten protest
     with the District (copy attached), and thereafter had
     several meetings with District porsonnel, eiring which
     Protestant urged tht a site survey be carried out for
     the purpose of deternining whether the advertid spec-
     ifications were in fact substantially at variance with
