             This Is in referince to your letter of February 8, 1973, reference
        )AICT-F, requesting an advance decision cemcerniug the propriety of
        Mr, Gilbert E. Hueller'saaim for home puchase expcnues and additioaal
        temporary quarters expens incident to his permanent change of station
        from the United States Naval Station, Guantaaao Bay, Cuba, to the Army
        Corps of Engineers Are Office, Wright Pattermion Air Force Base, Dayton,
        Ohio, during the summer of 1972. Your letter was. assigned PDTAXAC Con-
        trol Wo. 73-18 by the Per Diem, Travel and Tramportation Allowance
        Committee and forwarded here on April 4, 1973.

             The Naval Station, uantsva Bay, Cuba, issud permanent duty
        travel orders to ir. Ifueller, a civilian eWloyee, on June 27, 1972,
        authorizins temporary quarters suboistence expenses for a periTod of
        30 days.  owever, the orders did not authorize real estate expenses.
        Upon arrival in Dayton, Ohio, on September 17, 1972, be and his family
        took up residence in temporary quarters. On or about October 2. 1972,
        Mr. Muefler realized he would be unable to obtain posseision of and
        occupy permanent quarters by October 17, 1972, the end o! his authorized
        30-day temporary quarters subsistence expenses alaovance period and,
        therefor, trequested his orders be amended to authorize both a 10-day
        exteansi to the temporary quarters allowance period and veal estate
        expenses. Your office denied the requeot on the basis that the Naval
        Station, Ouantanno Bay, Cuba, is not considered a possessiot of the
        United States and therefore eligibility for the additional benefite did
        not exitt under the applicable law and regulations.

            Subsequntly, on Jtnuary 23, 1973, t. Mueller submitted a travel
        voucher for rimbursemenz of $808.67 real estate expenses and $218.82
        for a 10-day extemsiou of tmporary quarters subsistence expanses con-
        tending that tha Naval Stattion, Cuantanamo By, Cuba, is in fact a
        posssion of the United States in that the Government owns a lwoe.old    .
