Leon Braun Presidcnt Gentlement We refer to your letter of Fay 29, 1973, requosting reconsideratlon of our decision of April 10, 1973, affiraed by decicion of May 22, 1973, denying your protest against award of a contract to any firm other than folecular under Invitation for Bids No. 500017-73-B-I107. issued by the Navy Purchasing Office, Washington, D. C. Award waa made to Yardney Elpctric Corporation on April 17, 1973. In otvr initial consideration of your protest befors award you argued that although the solicitation did not list destination points for the items in question (batteries), it was feasible to ev luate transportation coots for f.o.b. origin bids because the destination points generally were known and the shipping weights of the batteries wore readily ascertainable. You pointed out that in fact the Navy procurenent officials'calculated the transporta- tion costs by estL'-ting that half of the batteries would go to Yorktown, Virginia, and half to Sar Fraccisco, California. Since th% six posuibte destination points to stich these batteries would bo shipped include Yorktown (Virginia), Charleston (South Carolina), and Earle (New Jersey) on the east coast, and Keyport (Uashington), Sn Dieso (California). and Concord (California) on the west coast, you contended that tentative destination points and quantities to each destination point easily could have boin established for bid evaluation purposes. The Wavy reported however that when *the sollcitation was drafted it was the contracting off1cer,'s judgment that thn desti- nation points were so much a matter of-speculation as to make it impracticable for the Command to realistically project where deliveries would be made then the batteries were delivered from IQ
