 Dear ?r. Stokton:

     Thi@in in referene to your letter of April 26, 1973, appealing
 the settlement by our Transportation and Claim Division, dated April 11,
 19739 that disallovad your claim for living quarters allowance as a
 Depsrtwet of the Wavy civilian employae stationed in Yokosuka, Japan.

     The record shows that you arrived tn Japan in February 1955 as an
 employee of the Philco Corporation at the U.S. Naval Ship Repair Facility
 in Yokosuka. Your employer hold a United States Governent contract to
 provide technicians kown as Technical Representatives (TechRaps) for
 the maintenance of Governmeut equipment. You occupied a TechRep position
 wilth Philco Corporation until July 1966 when you terminated your employ-
 meat to begin a private business venture (trading company) in Japan.
 On April 22, 1968, you accepted a GS-836-11 overseas limted oppointment
 a a local hire Deparment of the Navy civillan by the U.S. Naval Shore
 Electronics Division, Ship Repair Facility, Yokosuka, nov knowna - the
 U.S. Naval Shore Electronics Engineering Activity, Japan. As a con-
 dition of employment, you were required to travel from Japan to Okinava
 at your own expense and on your ova tine, where you were authorited
 transportation and travel expenses from Okinava to Japan on your first
 day of employment. This procedure was employed by your orgsanization
 with your concurrence and cooperatloq to preclude a lengthy vatting
 perlod that would have been required t* obtain permission and visa
 changes from the Japanese Government for your eployment. As a part of
 yOur employment procesong, you were given and required to signa trans-
 portation agreement providing for the return of yourself, your famly
 and household goods to Montrose# Iowa, tho place claimed as your resi-.
 deuce in the United States. The Consolidated Civilian Personnel Office,
 Yokosuka, Japan, in November 1968 apparent y discovered that, as a local
bits employee, you vere not entitled to a trunsportation agreement and
requests4 you to return your copy of the agrment to that office. The
transportation eremnt was then destroyed a.A your records were corrected
to delete all reference thereto.
