Mr. BROOKS, from the Committee on the Judiciary,
submitted the following
REPORT
together with
DISSENTING VIEWS
[To accompany H.R. 4017]

The Committee on the Judiciary, to whom was referred the bill
(H.R. 4017) to amend title 28, United States Code, to prevent ra-
cially discriminatory capital sentencing, having considered the
same, report favorably thereon without amendment and rec-
ommend that the bill do pass.
SUMMARY AND PURPOSE
The purpose of this Act is to provide an effective remedy for ra-
cial bias in death sentencing. To prove the influence of race in a
particular case, the Act allows courts to consider evidence showing
a consistent pattern of racially discriminatory death sentences in
the sentencing jurisdiction, taking into account the nature of the
cases being compared, the prior records of the offenders, and other
statutorily appropriate non-racial characteristics. A person may in-
voke the Act to challenge a death sentence, but not the underlying
conviction. A person who successfully challenges the imposition of
the death sentence under the Act may be sentenced to any term
of imprisonment, up to and including life without possibility of re-
lease.
