   PRESIDENT OF THE UNITED STATES,

                               RELATING TO

        The  trial of Albert M. D. C. Lusk by a military commission.


 DECEMBER 16, 1867.-Referrpd to the Committee on the Judiciary and ordered to be printed.


 To the House of Representatives:
   In compliance with the resolution of the House of Representatives of the
 9th instant, I transmit herewith a copy of the papers relating to the trial, by a
 military commission, of Albert M. D. C. Lusk, of Louisiana. No action in the
 case has yet been taken by the President.

 Proceedings of a military commission which convened in the city of New
                 Orleans by virtue of the following orders:
                      [Special Orders No. 70.-Extract.]
                      HEADQUARTERS FIFTH MILITARY DISTRICT,
                                   New  Orleans, Louisiana, June 17, 1867.

  3. The  proper civil authorities having stated that it is impossible for them to
take charge of Albert M. D. C Lusk, of the parish of Carroll, State of Louisiana,
accused of murder, and that it is impracticable to administer justice in his case
through the civil courts, a military commission is hereby ordered to convene in
this city at 10 o'clock a. m. on Thursday, the 20th instant, or as soon thereafter
as practicable, for his trial, and for that of such other persons as may be prop-
erly brought before it.
