REPORT
[To accompany S. 1380]
Tie Committee oil the District of Columbia to whom was referred
the bill (S. 1380) to amend section 801 of the act entitled An act to
establish a code of law for the District of Columbia, approved March
3, 1901, after full consideration, report favorably thereon with amend-
ments and recommend that the bill as amended do pass.
The amendments are as follows:
Page 2, strike lines 12 and 13.
Page 2, line 14, strike Cases and insert in lieu thereof  'Cases.
Page 2, line 15, after tile word of insert the words sentence or.
Page 3, line 2, after the word may insert the words by unanimous
vote.
iThe purpose of this bill is to amend section 801 of the act entitled
An act to establish a code of law for tile District of Columbia,
approved March 3, 1901 (31 Stat 1189, 1321, see 22-2404, D.C. Code,
1951 edition), so as to abolish mandatory capital punishment of murder
in thle first degree in tile District of Columbia.
Tile committee desires to commend the Honorable Kenneth Keat-
ing, junior Senator from the State of New York, for his persistent
efforts in pursuing an objective of bringing anl end to mandatory
capital pu nishimnent, in the Nation's Capital City.
At hiearings on this bill, introduced by Senator Keating, he testified
that mandatory capital punishment is 'blind justice, not justice blind-
folded, and-
It is my firm belief that tile mandatory deathi penalty is
self-defeating and has operated to hamper ratier than en-
hance effective law enforcement in the District of Columbia.
