                    The  Committee on Environment  and Public Works, to which was
                  referred the bill (S. 1324) to require the Administrator of the Envi-
                  ronmental  Protection Agency to fulfill certain requirements before
                  regulating standards  of performance for new,  modified, recon-
                  structed fossil fuel-fired electric utility generating units, and for
                  other  purposes, having considered the same,  reports favorably
                  thereon without amendment  and recommends  that the bill do pass.
                               GENERAL  STATEMENT  AND BACKGROUND
                    On  June 25, 2013, President Obama announced his Climate Ac-
                  tion Plan which provided three main categories of action: cut car-
                  bon  emissions in America, prepare the U.S. for the impacts of cli-
                  mate  change, and lead international efforts to address global cli-
                  mate  change. As a part to this plan, the President issued an Execu-
                  tive Order directing the EPA to set standards of emissions reduc-
                  tions for new and existing fossil fuel-fired power plants.
                    New  Source Performance Standard: On  September 20, 2013, the
                  EPA  re-proposed CO2 emissions limits for new power plants. The
                  proposal, entitled Standards of Performance for Greenhouse Gas
                  Emissions for New  Stationary Sources: Electric Utility Generation
                      59-010
