                   AMENDING THE INDIAN TRIBAL ENERGY DEVELOPMENT
                     AND   SELF-DETERMINATION ACT OF 2005, AND FOR
                     OTHER   PURPOSES

                      Mr. BARRASSO, from the Senate Committee on Indian Affairs,
                                       submitted the following


                                          REPORT

                                          [To accompany S. 209]
                     The Committee  on Indian Affairs, to which was referred the bill
                   (S. 209) to amend the Indian Tribal Energy Development and Self-
                   Determination Act of 2005, and for other purposes, having consid-
                   ered the same, reports favorably thereon without amendment and
                   recommends  that the bill do pass.
                                              PURPOSE
                     The purpose of S. 209 is to amend certain provisions of the En-
                   ergy Policy Act of 2005 1 to further enhance the ability of Indian
                   tribes to exercise self-determination over the development of energy
                   resources located on tribal lands; to establish tribal biomass dem-
                   onstration projects; to improve, facilitate, and make more effective
                   the implementation of the program in Indian Country under  sec-
                   tion 413(d) of the Energy Conservation and Production Act2; and
                   to otherwise facilitate Indian tribal governments in their goals to
                   develop both renewable and non-renewable energy resources for the
                   benefit of current and future generations of Indian people.
                                       NEED  FOR LEGISLATION
                     For several years the Committee has received concerns from In-
                   dian tribes that the many Federal laws governing the development

                   'Energy Policy Act of 2005, Pub. L. No. 109-58, 119 Stat. 594 (2005) (codified in scattered
                   sections of Title 25 U.S.C., 26 U.S.C., and 42 U.S.C.).
