                                         Purpose   and  Summary

                      H.R. 3089,  the NDO  Fairness  Act, introduced by Rep. Scott Fitz-
                    gerald (R-WI), would  amend   Title II of the Electronic Communica-
                    tions Privacy Act, known   as the Stored Communications Act.   The
                    bill sets limits on when a governmental  entity may delay notifying
                    an  individual after accessing  the  individual's private electronic
                    communications   (e.g., email) and after a governmental  entity ob-
