The Committee on Energy and Natural Resources, to which was
referred the bill (S. 2160) to establish a pilot program under which
the Chief of the Forest Service may use alternative dispute resolu-
tion in lieu of judicial review for certain projects, having considered
the same, reports favorably thereon with an amendment in the na-
ture of a substitute and recommends that the bill, as amended, do
pass.
The amendment is as follows:
Strike all after the enacting clause and insert the following:
SECTION 1. SHORT TITLE.
This Act may be cited as the Protect Collaboration for Healthier Forests Act.
SEC. 2. ALTERNATIVE DISPUTE RESOLUTION PILOT PROGRAM.
(a) DEFINITIONS.-In this Act:
(1) ARBITRATOR.-The term arbitrator means a person-
(A) selected by the Secretary under subsection (d)(1); and
(B) that meets the qualifications under subsection (d)(2).
(2) LAND AND RESOURCE MANAGEMENT PLAN.-The term land and resource
management plan means a plan developed under section 6 of the Forest and
Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C. 1604).
(3) PARTICIPANT.-The term participant means an individual or entity that,
with respect to a project-
