      EIGHTH CIRCUIT RL

      APPELLATE PROCEDURE



   Pursuant to the authority vested in the individual courts of
appeals by Rule 47 of the Federal Rules of Appellate Procedure,
this court adopts the Eighth Circuit Rules of Appellate Pro-
cedure, which shall govern appeals to this court from and after
October 1, 1981.




COMMITTEE COMMENT:

  The Eighth Circuit Rules of Appellate Procedure (8th Cir. R.)
supplement and modify the Federal Rules of Appellate Pro-
cedure (FRAP). Counsel should become familiar with both sets
of rules and the federal statutes governing appeals, particularly
28 U.S.C. §§ 1291 and 1292.

  For counsel's convenience, the committee has cross-
referenced the Eighth Circuit rules to the applicable Federal
Rules of Appellate Procedure.
