Brief in behalf of Defendant and Appellant.
On the 7th of March, 1859, the Plaintiff brought the
present action against the Defendant as the endorser of
nine certain promissory notes, dated 30th May, 1857, and
drawn by Melchior Michel to Defendant's order, and
amounting in the aggregate to the sum of five hundred and
forty-six dollars and seventy-five cents, exclusive of in-
terest, costs of protest, &c.
The Defendant in his answer, after pleading the general
issue, 'admitted that he had endorsed the notes sued on,
but only for the maker's accommodation, and specially
averred that he was discharged from all liability as endors-
er, by the Plaintiff's failure to notify him properly of the
