Plaintiff and Appellee's Brief.
Plaintiff claims of the defendant $789 46, with legal interest
from the 20th of July 1872, for this, to-wit:
That in March 1872, plaintiff, who is a commission merchant,
agreed with the defendant to ship to his (plaintiff's) friends in
Havana 2700 cross-ties (by a clerical error stated as 2200 in
the petition), to be sold in the Island of Cuba for account of
the defendant. That accordingly, about the 2d of April 1872,
plaintiff paid $75 for the towage from New Orleans to the land-
ing ou.the Mississippi river near Kennerville, of the brig on
board of which the ties were to be shipped, and also paid the
charges for insurance and clearance, and sundry petty expenses
amounting to $26 50, and, moreover, advanced to defendant
$1350 cash on said shipment.
Plaintiff avers that his friends and correspondents in
Havana, the firm of (aro Hermanos y Watson, received the
said consignment of cross-ties and sold the same at the best
rates they were able to obtain therefor; that the said sale
netted in Havana $715 77, which, converted into a draft on
New Orleans at the then current rate of exchange, gave
$698 32, as fully shown by the account sales rendered by the
said 9aro Hermanos y Watson and furnished the defendant.
That after debiting the defendant with the expenses and
sums advanced by plaintiff as aforesaid, as also with the usual
