Brief in behalf of Jacob Badinger, Defendant and Appellee.
For a correct understanding of this case, the Court will
have to refer to three transcripts, to-wit: Nos. 3533, 3290 and
2764.
The suit, as will be seen by the first pages of transcript
3290, was originally brought by the plaintiff, her two brothers,
Adolphe and Alphonse, and her sister Eulalie. The three
latter, it is admitted, have abandoned the suit. (See Judg-
ment, p. 110 of Record 3290).
There were also originally four defendants, viz:  M. A
Peyroux, P. O. Peyroux, Jacob Badinger, and H. Algeier.
The suit as to Algeier was abandoned.  See same Record, pp-
77 and 78.
It was then prosecuted against M. A. Peyroux and P. O.
Peyroux, and from the judgment rendered against the latter,
they appealed. Ib., p. 123 and p. 111.
As against Badinger, the case has been conducted as a
distinct suit, and separately tried.
The plaintiff, by her original petition, filed May 5th, 1869,
claims of Badinger an     undivided  portion  of a square
of ground   bounded   by  Roziere, Castiglione, Clay  and
