              OUR GRAND JURY SYSTEM.*



   Before the state should present an indictment or formal accu-
 sation of crime against a citizen, a preliminary investigation of
 some  sort is generally recognized as necessary.  Crime  seeks
 concealment.  It must in many  cases be searched for diligently
 with the aid of all the compulsory means of collecting evidence
 which the state can supply. After the evidence has been gathered
 some tribunal must  determine  whether  it makes out  a prima
facie case-whether   it amounts to enough  to make  it proper to
subject the suspected  individual to the suffering, expense and
shame   of a public trial for crime. Of course, the inquisitorial
tribunal which exercises such arbitrary powers, affecting life and
liberty, should be  carefully guarded against abuse-should   be
constituted with the possibility of abuse in view.
   In New Jersey, as in most if not all the other states of the Union,
