New Certification Standards
Prescribed for Estate Planning and
Probate Law Specialty
New standards and procedures proposed by the
Estate Planning and Probate Law Specialization Advi-
sory Board have been approved by the Supreme Court
Commission on Contint *ng Lawyer Competence, with a
proposed effective dat/ f Oct. 31.
Changes of particular interest relate to a reduction
in the specialty's annual CLE requirement and elimina-
tion of any waiver provision with respect to the written
exam. The proposed standards and procedures would
reduce the annual CLE requirement to 12 hours while
retaining the overall requirement of 90 hours to qualify
for recertification (certification is for five years). The
elimination of any waiver provision for the written exam
would require every applicant for certification to take
and pass the exam. Formerly, applicants with an LL.M.
in Estate Planning from the University of Miami Law
School and applicants with special or unusual qualifica-
tions could apply for a waiver of the written exam.
Reorganization of the standards and procedures
should make them easier to use and understand.
