Attorneys-Lawyers Title Gaurantee
Fund.
Inquiry. Filed October 24, 1957 meet-
ing. Facts stated in opinion.
Opinion. At the meeting of the Coun-
cil appearances were made by members
of the Bar and statements were made
orally and filed, dealing with the estab-
lishment by The North Carolina Bar As-
ciation of Lawyers Title Guarantee
Fund. The matter was referred to the
Ethics Committee for the purpose of re-
porting as to whether establishments of
such in this state would have any un-
ethical aspects. It is the opinion of the
Committee and the Council that there is
nothing unethical per se in establish-
ment of a Lawyers Title Guarantee Fund
and the Council and Committee has noth-
ing to do with the same, there being no
ethical problem presented by the inquiry.
OPINION NO. 225
(January 17, 1958)
Partnership-Attorneys.
Inquiry. Facts stated in opinion.
Opinion. A proposal by attorneys to
form association with another attorney in
adjoining community and said attorney
with attorneys in their community does
not present any question of ethics and
such arrangements are not in conflict
with any regulations of the State Bar.
OPINION NO. 226
(January 17, 1958)
Solicitation of Business-Minimum
fees.
Inquiry. Facts stated in opinion.
Opinion. It would be improper for an
attorney to contact clients or former cli-
ents with printed notices sent by mail
advising them of change in his fees for
service to accord with local Bar Associa-
tion minimum fee schedule.
OPINION NO. 227
(January 17, 1958)
Solicitation of Business--Titles-Par-
tition Proceedings.
Inquiry. Dated November 6, 1957.
Facts stated in opinion.
Opinion. It is not improper for Attor-
ney A to institute proceedings to cor-
rect defect in title which he is examining
if borrower B (who has requested loan
from lending institution who requests
lawyer A to examine the title) has re-
quested lawyer A to bring partition
proceedings to clear title. If so requested
by borrower B, lawyer A would not
be required to refer the matter to other
counsel.
