If you, as I, felt that the new Probate Code presents a veritable maze, permit me to share with you a few thoughts on real estate transfers affected by Title 18-A. From the perspective of a person who as a title examiner or as a conveyancer super- vising the purchase of property derived from a decedent, what must be abstracted and reviewed is of prime importance. The most frequent circumstances where real estate is involved will be those where the decedent's estate is being administered by a Personal Representative and either there is no will, or the will has been al- lowed.
