The Probate Code and Real Estate Transfers

Mr. Cowan is associated with the finn of
Perkins, Thompson, Hinckley     &  Keddy   in
Portland and is a graduate of Bowdoin College
and Harvard Law School. Mr. Cowan is a

member of the Advisory Committee on Probate
Rules, the American Colege of Real Estate
Lawyers and the American and Maine State Bar
Associations.
If you, as I, felt that the new Probate
Code presents a veritable maze, permit me
to share with you a few thoughts on real
estate transfers affected by Title 18-A.
From the perspective of a person who as
a title examiner or as a conveyancer super-
vising the purchase of property derived
from a decedent, what must be abstracted
and reviewed is of prime importance.
The most frequent circumstances where
real estate is involved will be those where
the decedent's estate is being administered
by a Personal Representative and either
there is no will, or the will has been al-
lowed.
Whether the proceedings have been in-
formal or formal, the personal represen-
tative has the power to sell the real estate
provided (a) he gives 10 days notice prior
