The Mental Health -Referral

When a client appears before an at-
torney for some legal action or advice,
how does the counselor know whether
evaluation and/or treatment of this per-
son by a mental health professional is
indicated? Nationally, we see a growing
tendency for mental health professionals
to work closely with legal, judicial, and
correctional officials to help assess mo-
tivations for behavior and alternative
courses of remedial action. However,
attending this union of the professions
is a host of problems relative to iden-
tifying those cases that can be helped
best by this rapprochement.
What are the signs that suggest re-
ferral of a client to a mental health
professional? What can    the mental
health professional contribute to help-
ing the lawyer better understand the
motivation behind a client's behavior?
How can legal, judicial, or correctional
actions be tempered or modified by such
understanding?  The   following  com-
ments are offered to help provide some
preliminary  understanding  in  these
areas.

The cases of Gideon v. ainwright,
Escobedo v. Illinois and Miranda v.
Arizona have collectively increased the
work of criminal lawyers. In general, a
suspect has a constitutional right to
counsel at a stage when he is either in
custody or significantly deprived of his
freedom and these rights go all the way
through his first appeal (Douglas v.
California, 372 U.S. 353) and beyond
into post conviction remedies. If the
suspect or accused cannot afford his own
counsel, even at the earliest stages, the
state must furnish him one and he is
supposed to be told this by the police
at once.
The question now facing Maine is
how best to provide these legal services
that the U.S. Supreme Court requires.
And if it is to be considered in the spirit
of the decisions requiring it, it must be
analyzed in terms of what is best for the
client, the bar, and our state.
