In this final Letter as President
of the Kansas Bar Association, I
wish to clarify two themes touched
upon in an earlier Letter and in
an article published in the Judicial
Council Bulletin.
It has been previously stressed
that the fundamental purpose of
Law is to provide the framework
needed to enable people to live together in an orderly and 'harmonious
society. I have a deep conviction that this basic principle must be the
constant guide star for our profession. If we professionally conceive of
Law as a system having as its purpose the promotion of controversy
between peoples, Law will become a force destructive of society and lawyers
will become executioners of society. This is an ever-threatening danger as
we so regularly function in an atmosphere of controversy.
Law does afford the means and framework for handling controversies
within society. This is one of its major functions. This is the relief valve
of society. It is the alternative to anarchy and violence or to absolutism
in its most virulent form.
Like a relief valve, the controversial process under Law must be to
dispose of controversy by peaceful means and permit maintenance of an
orderly and harmonious society. The function of a relief valve is to relieve
pressure and allow the continued and proper functioning of the equipment
to which it relates. It is not the function of the relief valve to blow up the
related equipment. Similarly, it is not the function of litigation under Law
to destroy society but to preserve it and permit it to function properly.
Members of the legal profession in performing their delicate functions in
legal controversy and litigation must at all times follow this guide star.
If we do not, we are no longer a constructive force in society. We are no
longer worthy to call ourselves a profession.
It is worthy to note that this same guide star, as to the purpose and
function of Law, caused lawyers in the United States through the American
Bar Association in conjunction with lawyers from other nations to initiate
the World Peace Through Law movement, which held its fifth world
conference in Belgrade last July. This endeavor seeks to substitute judicial
disposition of international controversies for force, violence and war. It
seeks to impress upon the legal profession internationally its responsibility
