Chief Justice calls for more
court resources for drug fight

Chief Justice Arthur McGiverin's
State of the Judiciary address. It
was delivered to the Iowa Judges
Conference December 6.)
Thank You, Judge Pelton.
My congratulations, Judge Pelton, for
your recent appointment to the board of
directors of The National Center for State
Courts located at Williamsburg,
Virginia. This is a tremendous honor
which reflects upon your dedication to
the judiciary.

I will not present a state of the
judiciary message to the legislature next
session because of the legislatu 's plan
to expedite the session. Inste-a Judge
Pelton has graciously allowed me to use
this opportunity to discuss the condition
of theJudicial Department and to discuss
the department's budget request for the
next fiscal year.
I want to recognize the officers and
board of governors of The Iowa State Bar
Association and other members of the
bar who are present.

Probate
delinquencies
rise again
According to reports filed with the
State Court Administrator, 52 of the 101
clerk's offices (Lee and Pottawattami
Counties have two) reported no probate
delinquencies as ofJuly 1, 1989. This is
a seven-fold increase in the number of
counties reporting no probate delinquen-
cies since July 1982 when only seven
counties so reported.
In addition, Norman Bastemeyer,
Ethics Administrator, Iowa State Bar
Association, reported the number of
probate delinquency complaint files
opened decreased from 1,962 in fiscal
year 1983-84 to 181 in fiscal year
1988-89.
The downward trend, however, may
be ending. The 482 probate delinquences
reported by the clerks for theJuly 1989
period was more than double the
number (185) reported inJanuary 1989
and 40 percent more than the number
(293) probate delinquencies reported in
July 1988. The probate delinquencies
reported by the clerks in July resulted in
the filing of 298 complaints with the
Iowa Bar Ethics Committee. No com-
plaints were filed in 184 cases which
could not be processed for various
reasons, such as: no designated attorney
(165), designation of a firm rather than
an individual attorney (11), or the
attorney designated was deceased,
suspended or out-of-state (8).
The number of probate delinquency
complaint files opened by the Iowa Bar
Ethics Committee since fiscal year
1982-83 is illustrated in the accompany-
ing chart.
