PREMIUMS TO INCREASE SHARPLY IN 1986

BOARD VOTES
RESOLUTIONS
ON PROPOSALS
TO MODIFY
TORT SYSTEM
The Association's Board of Gover-
nors spent a considerable portion of
the December 10 and 11, 1986 Board
Meeting in discussions of various
claims being made by physicians, in-
surance companies and other interest
groups that the tort reparation system
needs modification. Among the items
discussed were the proposals set forth
by the Iowa Medical Society. (A com-
plete copy was sent each member).
As a result of the debate the Board
passed two resolutions.
The first resolution passed read:
RESOLVED that the Board of Gover-
nors reaffirm existing Board policies
opposing caps on damage awards
and opposing limits on plaintiff's
attorney contingency fees and that
The Iowa State Bar ssoclation ac-
tively oppose legis! live efforts to
modify the present tort reparation
system.
The second resolution Is as follows:
WHEREAS it is the desire of The
Iowa State Bar Association to further
the interest of the people of the
State of Iowa.
IT IS THEREFORE RESOLVED that

The Board of Governors voted at the
December 10-11, 1985 meeting to re-
new the endorsement for another year
the Home Insurance Company as the
Association's endorsed lawyer liabil-
ity insurance carrier. The Board first
endorsed Home at its November
30-December 1, 1984 meeting. The
Board vote approved the recommenda-
tion of the Lawyers Professional
Liability Committee of the Association.
The Committee's report to the Board
showed that Association members
who wrote coverage through Home
after the Board's endorsement saved
over 3 million dollars in premiums in
calendar year 1985. The savings were
calculated by computing what the
members would have paid the pre-
viously endorsed carrier using its
quoted rates and the amount which
was actually paid to the Home Insur-
ance Company.
The endorsement renewal was ap-
proved despite the Committee's report
that 1986 insurance premiums for
members insuring with the Home In-
surance (the Bar endorsed carrier), will
increasc approximately 55 percent in
average cases. Factors which will af-
fect your rates are:
(1) A base rate (i.e., 100,000/300,000
with $1,000 deductible) increase of 35
percent will affect all lawyers insured
by Home in Iowa;
(2) A reduction in deductible credit
by 10 percent will affect all lawyers in
the plan;
